Church Victim Compensation Funds for Clergy Abuse
An Independent Victim Compensation Program (“IVCP”) is to provide compensation to victims of clergy sexual abuse of minors. An IVCP provides victims with an alternative to litigation providing victims a transparent process to resolve their claims with a significantly lower level of proof and corroboration than required in a court of law.
In February 2019, Kenneth Feinberg and Camille Biros were named as administrators of a New Jersey state-wide compensation program. The state-wide program was endorsed by all five Roman Catholic Dioceses (Newark, Trenton, Camden, Paterson, and Metuchen). In other states, such as New York and Pennsylvania, each individual diocese has decided for itself whether to create such a program and, if so, what terms and conditions would apply.
New Jersey IVCP
INDEPENDENT VICTIM COMPENSATION PROGRAM (“IVCP”) for The Archdiocese of Newark and the Dioceses of Camden, Metuchen, Trenton and Paterson For Compensation of Certain Individual Claims of Clergy Sexual Abuse of Minors by Clergy
The claim of clergy sexual abuse must be directed against clergy of the one of the following New Jersey Dioceses:
- – Archdiocese of Newark
- – Diocese of Camden
- – Diocese of Metuchen
- – Diocese of Trenton
- – Diocese of Paterson
Claims against members of a religious order, clergy of any other archdiocese or diocese, or a lay person are not eligible under this program.
The deadline to register a new allegation is October 31, 2019. The deadline for submission of a claim is December 31, 2019. After this, new claims can be submitted on a case-by-case basis.
New York Independent Reconciliation and Compensation Programs (“IRCP”)
Diocese of Rockville Centre
Effective January 29, 2019, The Diocese of Rockville Centre has implemented Phase III of the IRCP addressing claims of abuse by members of religious orders, who have worked under contract or by official assignment in the parishes, schools or charitable agencies of the Roman Catholic Diocese of Rockville Centre.
The Deadline for registration of new claims has been extended to December 30, 2019. The deadline for filing your completed claim has been extended to January 15, 2020. After this, new claims can be submitted on a case-by-case basis.
